1. Acceptance of Terms

By downloading, installing, or using Trail Paws ("the app", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

2. Description of Service

Trail Paws is a trail and hiking application that allows you to:

• Discover dog-friendly trails in Boulder, Colorado (OSMP)
• View dog regulation information (leash rules) for trail segments
• Plan hiking routes with distance, elevation, and time estimates
• Track hikes with real-time GPS
• Record your own walking or hiking routes

3. Trail Data and Accuracy

3.1 Data Sources

Trail and dog regulation data is sourced from the City of Boulder Open Space and Mountain Parks (OSMP) public dataset. This data is provided as-is by the city and may not reflect the most current conditions.

3.3 GPS and Navigation

GPS accuracy depends on your device, satellite visibility, terrain, and weather conditions. Trail Paws is not a substitute for proper trail maps, navigation equipment, or outdoor preparedness. Always carry appropriate supplies and know your route before heading out.

3.4 Time and Distance Estimates

Hike time and distance estimates are approximations based on trail data and standard hiking pace calculations. Actual times will vary based on fitness level, weather, trail conditions, group size, and other factors.

4. Outdoor Safety

Trail Paws is a supplementary tool for trail exploration. You acknowledge that:

• Hiking and outdoor activities involve inherent risks including injury, wildlife encounters, and changing weather
• You are solely responsible for your safety and the safety of your pets while on trails
• The app is not a substitute for proper outdoor preparation, training, or equipment
• You should always inform someone of your hiking plans and expected return time
• You are responsible for complying with all local regulations, including dog leash laws

5. Acceptable Use

You agree not to:

• Use the app for any illegal purpose
• Reverse engineer, decompile, or disassemble the app
• Redistribute, sell, or commercially exploit the app without permission
• Use the app in any way that could endanger yourself, others, or wildlife

6. Intellectual Property

6.1 Our Property

The app, including its design, features, and code, is owned by Certificate Services LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

6.2 Trail Data

Trail data is sourced from publicly available City of Boulder datasets. We make no proprietary claim over this public data.

6.3 Your Content

You retain ownership of any content you create within the app, including recorded routes, hike logs, and favorites. All your content is stored locally on your device.

7. Privacy

Your use of the app is also governed by our Privacy Policy, which describes how we handle your information. In short: everything stays on your device.

8. Disclaimers

To the maximum extent permitted by law:

• We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• We do not warrant that the app will be uninterrupted, error-free, or that GPS tracking will be accurate
• We do not warrant the accuracy or completeness of trail data, regulation information, or route calculations
• We do not warrant that trail conditions are safe for hiking or that regulations shown are current

9. Limitation of Liability

To the maximum extent permitted by law, Certificate Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Personal injury or property damage arising from outdoor activities
• Fines or penalties resulting from reliance on regulation data
• Loss of data stored on your device
• Inaccurate GPS tracking, route calculations, or time estimates
• Damages arising from reliance on trail data or navigation features

10. Indemnification

You agree to indemnify and hold harmless Certificate Services LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app or violation of these Terms.

11. Changes to the Service

We reserve the right to:

• Modify or discontinue features at any time
• Update the app to fix bugs or add features
• Change these Terms with notice to users

Continued use of the app after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Colorado.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Certificate Services LLC regarding the app.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
